1. General
These Terms and Conditions apply to all orders placed with BigSur Limited trading as Capsule Homes Ireland (capsulehomes.ie) (“the Company”, “we”, “us”, “our”).
By placing an order, the customer agrees to these Terms.
These Terms are governed by the laws of the Republic of Ireland.
2. Planning Permission and Building Regulations
Ensuring compliance with planning permission, exempted development rules, and building regulations is the sole responsibility of the customer and landowner.
The Company does not provide legal or planning advice and is not responsible for verifying whether planning permission is required.
Customers must confirm requirements with:
- Local County Council
- Building Control Office
- Architect / Engineer
Failure to obtain required permissions does not cancel the order.
3. Product Description
Capsule homes are prefabricated modular structures manufactured off-site and delivered ready for installation.
Due to the nature of modular construction:
- minor cosmetic variations may occur
- sealant lines, panel joints, or transport marks may be visible
- product may differ slightly from images

4. Orders and Payment
Orders are confirmed only after:
- written order confirmation
- payment or deposit received
Full payment is required before delivery unless agreed in writing.
Payment methods:
- Bank transfer
- Approved payment method
Prices are in Euro (€). Prices are exclusive of VAT unless stated. VAT is charged at the Irish rate where applicable. The Company may correct pricing errors.
5. Custom Orders / Made to Order Products
Capsule homes are made to order.
Under EU consumer law, custom-made goods may not be cancelled once production has started. Deposits are non-refundable after production begins.
6. Delivery
Delivery available across Ireland. Typical delivery cost: €1,500 – €2,000 (may vary depending on location).
Additional delivery costs may apply for:
- remote areas
- restricted access
- special transport
- ferry transport
Delivery vehicle:
- approx 7.5 tonne truck
- approx 8 m long
- approx 2.6 m wide
Weight of unit: 3–10 tonnes depending on model.
Customer must ensure safe access. Damage to driveways, lawns, walls etc due to access limitations is customer responsibility.
7. Crane / Lifting Equipment
If crane, teleporter, or lifting equipment is required, the customer must arrange and pay for it unless agreed in writing.
The Company is not responsible for lifting or positioning unless included in writing.
8. Site Preparation
Before delivery customer must ensure:
- clear access
- level ground
- suitable base / foundation
- space for installation
- access for truck / crane
Customer must provide:
- electricity
- water
- drainage / septic
- gas if required
Installation may be postponed if site not ready. Additional charges may apply.
9. Delivery Timing
Delivery dates are estimates.
Delays may occur due to:
- shipping
- weather
- factory delays
- customs
- force majeure
Delivery time is not guaranteed.
10. Failed Delivery
If delivery fails due to customer:
- no access
- no one present
- site not ready
Customer pays redelivery. Typical failed delivery charge:
- Up to €1,000 order — €500
- €1,000–€3,500 — €800
- Over €3,500 — €1,500
Additional charges may apply.
11. Installation
Installation is not included unless agreed.
If installation is included:
- must be done on prepared site
- delays caused by customer are chargeable
If third party installs: Company not responsible.
12. Transfer of Risk and Ownership
Risk passes on delivery. Ownership remains with Company until full payment received. Customer may not resell before payment.
13. Warranty
Products conform to specification at delivery.
Warranty does not cover:
- wear and tear
- misuse
- incorrect installation
- poor foundation
- weather damage
- modifications
- third-party work
Prefab products may show minor marks or joints. This is not a defect. Statutory rights not affected.
14. Liability
We are not liable for:
- planning issues
- site problems
- third party work
- loss of profit
- delays beyond control
We are liable only where required by Irish law. Nothing limits liability for:
- death
- personal injury
- fraud
15. Customer Responsibilities
Customer must obtain:
- planning permission
- landlord consent
- neighbour access
- building compliance
Customer must provide utilities. Customer must ensure safe access. Extra costs caused by customer are payable.
16. Force Majeure
We are not liable for delays caused by:
- weather
- shipping delays
- strikes
- customs
- war
- government rules
- factory delays
- power failure
